Just to summarize, I had two Labor using EB2 category (One regular PD-2006 and other LC SUB PD-2001), hence my lawyer filed two I-140’s and during USCIS open the flood gate he filed my and families 485’s.
I have BCOM and 1 yrs of Law education, and recently I got educational RFE’s on both I-140’s, my lawyer did the detailed educational re-evaluation showing I have total 32 US credits which are equivalent with US degree and submitted to USCIS.
Last week I got notification saying both I-140’s and I-485’s are denied and USCIS mentioned in the denial notice that it dose not qualify the educational qualification for EB2 category.
After discussing with my Attorney, he gave me two options:
1. He will file Motion to Reconsider and he mentioned that there are very slim chances of getting anything out of it.
2. He will file another Labor in EB3 category.
I have valid H1B and Petition till Sep-09.
Do I have any other options?
